NeuroEquilibriumprovides the Services in partnership with its agents, affiliates, associates, representatives or otherthird parties (together referred to as “Partners”)

By registering, visiting and using the Website or accepting this Agreement, yourepresent and warrant to NeuroEquilibrium that you are 18 years of age or older, and that youhave the right, authority and capacity to use the Website and the Services available through theWebsite, and agree to and abide by this Agreement.

AlthoughNeuroEquilibrium will not be liable for your losses caused by any unauthorized use ofyour account, you may be liable for the losses of NeuroEquilibrium or others due to suchunauthorized use.

If a User provides any information that is untrue, inaccurate, not current or incomplete (orbecomes untrue, inaccurate, not current or incomplete), or NeuroEquilibrium hasreasonable grounds to suspect that such information is untrue, inaccurate, not current orincomplete, NeuroEquilibrium has the right to discontinue the Services to the User at itssole discretion.

It is your responsibility to keep your correct mobile number and email ID updated in theWebsite or App. All reminders and notifications will be sent to the account associatedwith this mobile number and/or email ID. Every time you change any contact information(mobile or email), we will send a confirmation. NeuroEquilibrium is not responsible forany loss or inconvenience caused due to your non-updation of your contact details
j. NeuroEquilibrium and its Partners may use such information collected from the Usersfrom time to time for the purposes of debugging customer support related issues.

NeuroEquilibrium may now or in the future provide Services where you may be able toconverse with NeuroEquilibrium, its authorized representatives, its doctors or similarstakeholders via online chat, text messages, video call or voice call. When you choosethis option, the records of such conversations, calls or exchanges may be recorded andstored in NeuroEquilibrium’s or its Partners servers. Such records are dealt with only inaccordance with the terms of the Privacy Policy. NeuroEquilibrium and its Partnersaccept no liability if you choose to use such a facility to interact with doctors or cliniciansor if the facility is not used in accordance with the foregoing.
l. You may be provided with a personal health record facility to add, modify,deleteandmanageyourhealth related records and information. The specific terms relatingto this are as below, without prejudice to the rest of these Terms and the Privacy Policy:

NeuroEquilibrium collects, directly or indirectly, and displays on the Website, relevantinformation regarding the profile and practice of the Practitioners listed on the Website,such as their specialisation, qualification, fees, location, visiting hours, and similardetails. NeuroEquilibrium takes reasonable efforts to ensure that such information isupdated at frequent intervals. NeuroEquilibrium cannot be held liable for anyinaccuracies or incompleteness represented from it, despite such reasonable efforts.

The Services provided by NeuroEquilibrium or any of its licensors or Partners areprovided on an “as is” and “as available’ basis, and without any warranties or conditions(express or implied, including the implied warranties of merchantability, accuracy, fitnessfor a particular purpose, title and non-infringement, arising by statute or otherwise in lawor from a course of dealing or usage or trade). NeuroEquilibrium and its Partners do notprovide or make any representation, warranty or guarantee, express or implied about theWebsite, App or the Services. NeuroEquilibrium and its Partners do not guarantee theaccuracy or completeness of any content or information provided by Users on theWebsite. To the fullest extent permitted by law, NeuroEquilibrium and its Partnersdisclaim all liability arising out of the User’s use or reliance upon the Website, App, theServices, representations and warranties made by other Users, the content or informationprovided by the Users on the Website, or any opinion or suggestion given or expressed byNeuroEquilibrium or its Partners or any User in relation to any User or services providedby such User.

NeuroEquilibrium and its Partners assume no responsibility, and shall not be liable for,any damages to, or viruses that may infect User’s equipment on account of User’s accessto, use of, or browsing the Website or App or the downloading of any material, data, text,images, video content, or audio content from the Website or App. If a User is dissatisfiedwith the Website or App, User’s sole remedy is to discontinue using the Website or App.

If NeuroEquilibrium determines through feedback or otherwise that you have providedfraudulent, inaccurate, incomplete or false information, NeuroEquilibrium reserves theright to immediately suspend your access to the Website or any of your accounts withNeuroEquilibrium and makes such declaration about suspension on the website alongsideyour name as determined by NeuroEquilibrium for the protection of its business and inthe interests of Users. You shall be liable to indemnify NeuroEquilibrium and its Partnersfor any losses incurred as a result of your misrepresentations or fraudulent feedback thathas adversely affected NeuroEquilibrium, its Partners or its Users.

While NeuroEquilibrium will try to ensure a confirmed appointment with a medicalservice provider (like doctor or diagnostic lab) for a User who requested an appointmenton the Website or App, NeuroEquilibrium or its Partners do not guarantee that the Userwill get a confirmed appointment. Further, NeuroEquilibrium and its Partners have noliability if such an appointment is confirmed but later cancelled, postponed orrescheduled by the hospital or medical service provider, or the medical service providerare not available as per the given appointment time.
b. NeuroEquilibrium or its Partners may provide value added services which connect Usersdirectly to the medical service providers via video call, voice call, text message, onlinechat or other electronic means and the information exchanged between the User and themedical service provider is stored and used in accordance with the Privacy Policy.However, it is at the discretion of the User, to avail such Service if it is available.
c. You understand and agree that any interactions and associated issues with other Usersincluding but not limited to your health issues and your experiences is strictly betweenyou and the other Users. You shall not hold NeuroEquilibrium or its Partners responsiblefor any such interactions and associated issues and NeuroEquilibrium will not be heldresponsible or liable for the same. For avoidance of doubt, the Services are not to provideany healthcare or medical advice or diagnosis and hence NeuroEquilibrium and itsPartners are not responsible for any medical or other outcomes between you and themedical service providers you interact with, pursuant to any interactions on the Websiteor App. If you decide to engage with a medical service provider to provide medicalservices to you, you do so at your own risk. NeuroEquilibrium or its Partners shall not beresponsible for any breach of service or service deficiency by any medical serviceprovider you connect, engage or transact with using the Website or App. We advise youto perform your own investigation or get feedback prior to selecting a doctor or any otherservice provider available on the Website or App.
d. Without prejudice to the generality of the above, NeuroEquilibrium or its Partners willnot be liable for:i. any wrong medication or treatment quality being given by the doctor(s),diagnostic service provider(s), pharmacy(s), or any medical negligence on part ofthe any of the above;ii. any type of inconvenience suffered by the User due to a failure on the part of themedical service provider including doctor to make himself/herself available at theappointed time, no show by the doctor, inappropriate treatment, or similardifficulties;iii. cancellation or rescheduling of booked appointment or any variance in the feescharged;iv. any medical eventualities that might occur subsequent to using the services of adoctor, diagnostic lab services, pharmacy, whom the User has selected on thebasis of the information available on the Website or App or with whom the Userhas booked an appointment or performed a transaction through the Website orApp.
e. Further, NeuroEquilibrium shall not be liable, under any event, for any comments orfeedback given by any of the Users in relation to the services provided by another User.All such feedback should be made in accordance with applicable law. The option ofUsers to give feedback remains at NeuroEquilibrium’s sole discretion and may bemodified or withdrawn at its sole discretion. NeuroEquilibrium may moderate suchfeedback at any time. NeuroEquilibrium shall not be obliged to act in any manner to giveeffect to the content of Users’ feedback.
a. The Website and App provide you the ability to pay online through a third party paymentgateway for some of the Services available on the Website or App.

NeuroEquilibrium may disclose or transfer User-generated information to its affiliates orgovernmental authorities in such manner as permitted or required by applicable law, andyou hereby consent to such transfer. In the event you suffer as a result of access or usage of our Website by any person in violation ofRule 3 of the IG Rules, please address your grievance to the above person.
If any provision of the Agreement is held by a court of competent jurisdiction or arbitral tribunalto be unenforceable under applicable law, then such provision shall be excluded from thisAgreement and the remainder of the Agreement shall be interpreted as if such provision were soexcluded and shall be enforceable in accordance with its terms; provided however that, in suchevent, the Agreement shall be interpreted so as to give effect, to the greatest extent consistentwith and permitted by applicable law, to the meaning and intention of the excluded provision asdetermined by such court of competent jurisdiction or arbitral tribunal.
No provision of this Agreement shall be deemed to be waived and no breach excused, unlesssuch waiver or consent shall be in writing and signed by NeuroEquilibrium.
